Obligations of businesses in the BDO system

Any activity involving the generation, treatment, recovery or disposal of waste, must be registered in the BDO system. The obligations arise from Law of 14 December 2012 on waste. The database on products and packaging and waste management (BDO) is a system that was introduced in Poland to improve waste management processes.

BDO - obligations to be fulfilled by the trader

Companies that market products such as oils, lubricants, pneumatic tyres and vehicles must register with the Waste Data Base (BDO). Registration is also mandatory for companies that collect, transport, process and recycle waste, including electrical and electronic equipment, batteries, accumulators and packaging. It must be done by entities engaged in the maintenance of order and cleanliness in municipalities and waste transporters. Sole traders who generate non-municipal waste are also required to register. Obligations of the entrepreneur concerned by the BDO include:

  • keeping records of the waste generated,
  • reporting on packaging introduced and waste generated,
  • pay the annual fee on time,
  • making updates to the system via an update request,
  • correctly assigning codes to the waste generated,
  • transfer of waste by issuing a KPO in the BDO system.

What are the penalties for non-compliance?

If the BDO obligation is not complied with, this carries serious legal consequences, which vary depending on the type of breach. Entrepreneurs may face both administrative and judicial penalties.

Administrative fines, imposed by the Provincial Inspector of Environmental Protection, can range from PLN 5,000 to PLN 1 million and are used in cases such as the conduct of business without a proper registration in the BDO Register or the absence of a registration number on company documents.

In contrast, more serious violations, such as failure to apply for entry, amendment of entry or deletion from the register, as well as false information in documents or improper record-keeping, mhese may result in criminal sanctions, including arrest or a fine, which can range from PLN 100 to over PLN 1 million. From 1 January 2020, a fine or jail sentence may also be incurred for failing to keep, provide or submit the required documents and for failing to provide the appropriate confirmations when transporting waste.
