Recycling charge

The recycling levy is an obligation that many businesses still treat too simplistically: the shop gives the customer a commercial bag, collects a small amount and considers the subject closed. In practice, it is one of those environmental obligations that combine sales, records, BDO and quarterly billing. If you run a shop or wholesaler and offer your customers plastic shopping bags covered by the recycling fee, you not only have to collect the corresponding amount from the customer, but you also have to keep records and submit the collected funds to the province marshal. Current regulations and official explanations indicate that the rate of the fee is PLN 0.20 per item and that the obligation to account appears quarterly. This means that the recycling fee is not just a price element at the checkout, but a fully-fledged environmental and reporting obligation.

Who is affected by the recycling levy and which bags do they cover?

The obligation applies to businesses operating retail or wholesale units that offer plastic shopping bags subject to a recycling fee. In practice, it is no longer just about thin „plastic bags”. Official information reminds us that the levy also covers plastic bags with a material thickness of 50 micrometres or more, and that only very lightweight bags used for hygiene reasons or as primary packaging for food sold in bulk when they help prevent food waste remain free. This is where a lot of mistakes occur: traders confuse the bags excluded from the charge with bags that are simply thicker or look „sturdier”. Meanwhile, the appearance of the bag itself is irrelevant if it falls within the statutory scope of the recycling levy.

How is quarterly billing and record keeping done?

The most important practical rule is: it is not enough to collect the charge from the customer, you still need to be able to document it. The entrepreneur is obliged to keep records of the number of purchased and issued lightweight and other plastic shopping bags subject to the recycling fee. On the basis of these records, he calculates the amount of the fee charged and submits it to the Voivodship Marshal with jurisdiction over the registered office or place of business. The deadline is rigid: by the 15th of the month following the quarter in which the fee was collected. In practice, this means that the shop should count the bags issued on an ongoing basis and not try to reconstruct the data at the end of the quarter from memory or from incomplete sales reports. It is the lack of up-to-date records that is one of the most common reasons for messy billing.

How does the recycling levy link to the BDO and the annual report?

The recycling levy does not end with the quarterly transfer. An entrepreneur offering bags covered by the fee should also have an entry in the BDO register and include data on such bags in the annual report on products, packaging and the management of waste arising from them. Official instructions from BDO and information from Biznes.gov.pl clearly indicate that shops and wholesalers offering bags covered by the recycling levy belong to the group of entities submitting such a report. This means that the data from the quarterly records should be consistent with the data entered later in BDO. In practice, the safest operating model is simple: you count the bags on an ongoing basis, settle the fee quarterly, and at the end of the year use the same data for the annual report. This is when the recycling levy ceases to be a source of chaos and becomes a predictable operational obligation.
