What is the annual report on waste generated and waste management?

The waste report regulates Law of 14 December 2012 on waste. This is a document that businesses are required to submit to the competent administrative authorities to report on the quantity, type and management of waste generated by their activities. This report is mandatory for waste generators and companies involved in waste processing, collection or extraction from landfills. This document contains details of the weight of waste, how it is treated and what products, if any, result from recovery or recycling processes. The report is intended to monitor waste management and enables control authorities to follow up on whether a company's activities comply with environmental requirements. Entities are required to submit a report on the packaging introduced by 15 March for the previous calendar year to the competent provincial marshal. What data does the annual report on waste generated contain?

The annual report on waste generated includes information on the company's waste management activities. Key data to be included in the report include:

  • entity identification data - registration number, company name, registered office address and nip number.
  • types and weight of waste generated - details of all types of waste generated during the activity,
  • waste management options - information on how the waste was managed, e.g. whether it was recycled, disposed of or sent for further treatment,
  • technical data of waste treatment facilities - information on the equipment used, its capacity, and any breakdowns or stoppages,
  • recovery and recycling - the weight and types of materials recovered or recycled from waste treatment.

The report may also contain additional information, depending on the specific activity, e.g. data on vehicle dismantling stations or waste water treatment plants.

Who is obliged to produce a waste report?

Various entities that come into contact with waste in the course of their activities are required to prepare an annual report on waste generated and on waste management. First and foremost, this applies to waste generators who are obliged to keep waste records, i.e. companies that generate waste in the course of their activities. The obligation also extends to waste management companies, such as waste collectors and processors, with the exception of municipal waste collectors. The report must be submitted by entities extracting waste from landfills or waste dumps, operating on the basis of permits or decisions concerning the operation of landfills after operation.
