BDO - who does not have to register? The database on products and packaging and waste management is a system for recording and monitoring waste in Poland, which is a key element of waste management control. Registering with the BDO and submitting reports are obligations that fall on many entrepreneurs. Nevertheless, there are certain groups of entities exempt from these obligations.
BDO - who does not have to register?
In the regulations, we will find precise information on who does not have to register with BDO. This includes Law of 14 December 2012 on waste. This is where you will find a list of entities and guidelines on who does not need to be in BDO. These are:
- natural persons and organisational entities which are not businesses - those entities that use the waste for their own purposes are exempt from registering with BDO. For example, if a private individual uses compost from organic waste in their garden, they are not obliged to register with BDO,
- operators of land applying municipal sewage sludge - if the sludge is used in agriculture, to grow plants for compost production, to grow non-food crops or for land reclamation, the landowner is also exempt from registration,
- non-professional collectors of packaging waste - This applies, for example, to those who collect used consumer goods, such as medicines and their packaging, as part of social or educational campaigns. Such activities, which are non-commercial in nature, do not require registration with BDO,
- transporting waste generated by itself - companies that transport waste generated by their own activities do not have to register with BDO, as long as they do not process or collect waste,
- operators who produce only municipal waste - if a company generates waste that is similar in nature and composition to municipal waste and is additionally covered by the municipal waste collection system, there is no need to register with BDO. This applies, for example, to offices or shops that do not generate industrial or hazardous waste.
All of these entities are bypassed by BDO registration. Those who do not need to make an entry should, however, bear in mind sustainability and the correct storage and disposal of waste.
Who does not have to submit a BDO report?
Not all businesses have to file waste reports. Who does not have to file a BDO report? Exemptions mainly apply to entities that do not carry out larger-scale waste generation or treatment activities. These include:
- entities that only hand over their waste to authorised collectors - if a company only hands over its waste to authorised collectors (e.g. treatment companies), there is no obligation to report as it does not carry out independent waste management,
- companies generating waste only in the social area - waste generated in the social area for employees, such as paper, plastic or food scraps, is treated as municipal waste, which exempts the company from BDO reporting if it does not generate other, more specific waste.
BDO report - who does not need to prepare in addition to those listed above? Entrepreneurs exempt from keeping waste records. When an entity does not have to keep waste records, it does not automatically have to report. If there is not enough certainty about whether a company is affected by the BDO register, who does not have to register can also be checked in a survey on the Product and Packaging and Waste Management Database website.
