The obligation does not apply to every online shop, but for large e-commerce, manufacturers, importers and distributors it can be one of the most important elements of compliance with the German VerpackG law. Failure to participate correctly in the dual system, incorrect data or failure to submit the required documents can mean a ban on trading in Germany and heavy financial penalties.

The Declaration of Completeness, or Declaration of Completeness, is a written and truthful confirmation of the volumes of packaging placed on the German market in a given year. The ZSVR indicates that the declaration must be examined and confirmed by an auditor registered in the LUCID register.

What is a VerpackG audit?

The VerpackG audit is an expert verification that a company correctly identifies its packaging, classifies it according to material fractions, contracts with the dual system, reports the masses in LUCID and complies with its obligations under the German Packaging Act.

In practice, the audit should not only check the LUCID number itself. The registration number is a starting point, but it does not yet prove that the company is accounting for packaging correctly. The key question is: Are the data reported to the dual system operator, the data in LUCID and the actual sales volumes to Germany consistent?

The VerpackG audit is particularly relevant for companies that:

have B2C sales to Germany,

sell through the marketplace,

use fulfillment,

import packaged products,

sell private label products,

have large volumes of cardboard, glass, plastics or lightweight packaging,

are approaching the thresholds of the Completeness Declaration,

need to sort out the data before the expert examination.

EKOPRO supports entrepreneurs in their obligations under the VerpackG/LUCID dual system as well as in billing and reporting on pre-packaging and transport. The natural link in this section is: solutions for the introduction of products and packaging in the EU.

What is a Completeness Declaration at LUCID?

The Completeness Declaration is a confirmation of the packaging data that a company has placed on the German market in the previous calendar year. Its purpose is to demonstrate that the company has correctly participated in the dual system and has financed the recycling of packaging covered by the mandatory participation system.

The ZSVR indicates that the declaration contains, among other things, data on the types of materials and weights of packages included in the participation scheme, information on the share of these packages in one or more schemes, and data on packages returned in specific models.

In practice, the Declaration of Completeness includes three levels of control:

Area

What is being checked?

Risks for the company

Material data

paper, cardboard, glass, plastics, aluminium, composites

misclassification of packaging

Packaging masses

previous year's volumes

under- or over-data

Dual system

compliance with contract and operator reports

no full participation system

LUCID

data consistency and timeliness

breach of reporting obligations

Audit

confirmation by an authorised expert

lack of effective certification

The Declaration of Completeness is not a simple sales report. It is a document that confirms the producer's responsibility for the packaging introduced into Germany.

When do you have to submit a Completeness Declaration?

A Completeness Declaration must be filed if the company has met or exceeded at least one of the statutory volume thresholds in the previous calendar year. The ZSVR indicates three thresholds: 80 000 kg of glass, 50 000 kg of paper, cardboard and paperboard combined and 30 000 kg of light packaging, including ferrous metals, aluminium, plastics, beverage cartons and other composites.

Material fraction

Annual threshold

Glass

80 000 kg

Paper, cardboard, paperboard

50 000 kg

Lightweight packaging

30 000 kg

The declaration shall be submitted annually to 15 May for the previous year. If 15 May falls on a weekend or holiday, the deadline is postponed to the next working day, but the ZSVR indicates that the deadline cannot be extended.

This means that the company should not start preparations in May. Data must be collected throughout the year and the auditor should have time to verify documents, compare reports and prepare confirmation.

Can the ZSVR request a Declaration of Completeness below the thresholds?

Yes. Even if a company has not exceeded the quantitative thresholds, the ZSVR and the competent authorities of the Länder may request a Declaration of Completeness. The ZSVR indicates that such a request may also be made to companies below the thresholds.

This is important for large, fast-growing online shops. A trader may consider that they are not subject to the obligation because they have not exceeded the thresholds, but they should still keep data in a way that allows them to defend their accounts. Not being required to automatically file a Completeness Declaration does not remove the obligation to report correctly in LUCID and the dual system.

Who can certify the Declaration of Completeness?

The Declaration of Completeness may only be audited and confirmed by authorised persons who are registered with the LUCID Packaging Register. The ZSVR indicates that these may be experts, auditors, tax advisors or sworn accountants who must apply the ZSVR audit guidelines for the Declaration of Completeness.

In practice, this means that the password „LUCID auditing”.” needs to be understood precisely. Any auditor from Poland or Germany is not sufficient. The person auditing the Declaration of Completeness must either be listed in the public register of auditors of the ZSVR or meet the relevant status required for this audit.

The ZSVR maintains public registers, including a register of producers, a register of auditors and a list of entities that have submitted a Declaration of Completeness.

What does packaging certification cover?

Packaging certification in the context of the Declaration of Completeness is not about marking an individual carton with a „certificate”. It is about confirming that the packaging data entered into Germany is complete, correct and in accordance with VerpackG.

The authorised auditor examines, among other things:

whether the company identifies packaging correctly,

that packaging has been allocated to the correct fractions,

whether the weight of the packaging is apparent from the source data,

whether the dual system operator's reports are LUCID compliant,

whether all brands, sales channels and distribution models are included,

whether there has been under-participation, i.e. under-reporting of packaging in the system,

that the data cover the correct reporting year,

whether there is documentary evidence of the calculation methodology.

The ZSVR publishes audit guidelines for the Declaration of Completeness and indicates that certain electronic forms, input screens and access to the LUCID register must be used when submitting the declaration.

What documents need to be prepared for a VerpackG audit?

Preparation for an audit should not start with an export of data from the marketplace. The auditor needs to see the full pathway: from product and packaging, to sales, to dual and LUCID submissions.

The company should prepare:

LUCID number,

company registration data,

list of brands,

agreements with dual system operators,

reporting Datenmeldung in LUCID,

volume confirmations from system operators,

sales statements to Germany,

data from the marketplace and its own shop,

data from fulfilment,

packaging specifications,

unit weights of packages,

packaging purchase invoices,

list of private label products,

import statements,

data on returns and corrections,

the procedure for counting the masses of packages.

For companies that are just preparing sales or want to sort out responsibilities before entering the German market, the EKOPRO website is a good starting point: LUCID audit - LUCID registration step by step. EKOPRO indicates there, among other things, support in the preparation of documentation and the implementation of solutions in line with current legislation.

E-commerce audit Germany - where are the most common errors?

In e-commerce, the problem is rarely a single document. More often than not, the error arises in the data model: the shop only counts the shipping carton, omits the product packaging, does not include the fillers or does not separate sales to Germany from sales to other EU countries.

The most common mistakes in e-commerce audit Germany:

inconsistency between LUCID and the dual system operator,

omitting product packaging when private labelling,

not including tapes, labels, fillers and films,

counting all EU sales instead of just the German market,

no differentiation between B2C and B2B,

incorrect classification of light packaging,

no data from fulfilment,

no control of marketplace data,

reporting of planned masses without actual adjustments,

no documentation confirming the unit weight of the packages.

For e-commerce operating in Poland and Germany, it is worth combining this topic with the EKOPRO article: Packaging in e-commerce and BDO and LUCID and with the service comprehensive environmental advice.

What is the process for submitting a Declaration of Completeness?

The ZSVR describes the process as an electronic submission of documents to the LUCID registry. Three elements are required: a manufacturer's declaration, an auditor or expert confirmation and an audit report.

Step 1: Start the procedure in LUCID

The company logs into LUCID and selects the Completeness Declaration module. It indicates the reference year and the basis for the declaration.

Step 2: Identification of the auditor

Before naming an auditor in the declaration, the company should already have a contractual relationship with the auditor. The ZSVR indicates that a contractual relationship with the auditor must exist before the auditor is identified as the responsible auditor in the Completeness Declaration.

Step 3: Entry of packaging volumes

The company enters the packaging weights according to the relevant categories and system operators. For packages covered by the participation system, volume confirmations must also be included.

Step 4: Generate a manufacturer's declaration

The system generates a manufacturer's declaration, which is the basic document confirming the reported data. The document should be consistent with the source data and system reports.

Step 5: Uploading audit documents

Finally, the audit documents are uploaded: the auditor's confirmation and the audit report. The ZSVR indicates that the final step can also be performed by the auditor, using their own login.

Why should an audit detect under-participation?

Under-participation refers to a situation where a company does not cover all the required packaging with the dual system or reports too low weights. This is one of the most serious risks in VerpackG, as it directly affects the financing of recycling.

The ZSVR points out that, in the authority's experience, audit guidelines are sometimes disregarded and auditors overlook cases of under-participation at obligated entities.

In practice, under-participation can arise when a company:

counts only the shipping packaging, but omits the product packaging,

reports data only from its own shop, but omits the marketplace,

does not include fulfilment,

does not count returns and corrections in a consistent manner,

there is no data on the weight of packages from suppliers,

reports only some brands,

does not update the data after an increase in sales.

A good VerpackG audit should proactively look for such gaps and not just confirm the data provided by the company.

Penalties for lack of LUCID in Germany and errors in the dual system

The risk in Germany is high, as violations of the VerpackG are treated as administrative offences and can lead to a ban on the distribution of packaged goods. The ZSVR points out that for breaches of the registration obligation, the penalty can be up to EUR 100 000, for violating the obligation of the participation system to 200 000 euro, and for breach of the obligation to report data to EUR 10 000.

However, the most important operational sanction is not only a fine. The ZSVR points out that any breach of the obligations under VerpackG leads to a ban on the distribution of packaged goods.

For the entrepreneur, this represents a real risk:

marketplace sales blockers,

interruptions of the fulfilment service,

loss of B2B contract,

control by the German authorities,

the need for urgent data supplementation,

fines of up to €200,000 for failing to participate properly in the dual system,

loss of revenue from the German market.

If a company sells large volumes to Germany, the VerpackG audit is not an administrative cost. It is a revenue protection tool.

When is a VerpackG audit particularly necessary?

A VerpackG audit is not only worth performing when a company has exceeded the Declaration of Completeness thresholds. In many cases, the audit should precede sales scaling.

An audit is particularly advisable when:

the company is approaching the thresholds of 80,000 kg of glass, 50,000 kg of paper/board/cardboard or 30,000 kg of light packaging,

e-commerce is growing rapidly on the German market,

sales take place in parallel through the company's own shop and the marketplace,

The company uses several fulfilment operators,

the brand sells private label products,

packaging data is collected manually,

previous submissions were prepared on an estimated basis,

the dual system operator received different data than LUCID,

The company has many brands and product categories,

is being prepared for examination by an authorised expert.

The safest model is an audit before the end of the reporting year. Then the counting methodology can still be improved, the data completed and the reporting corrected, rather than bailing out before 15 May.

VerpackG audit versus packaging certification - the practical difference

In business language, it is common to speak of „packaging certification”, but in the context of VerpackG it is more accurate to speak of certification or attestation of packaging data. The auditor does not certify the carton itself as a product. He certifies that the company has correctly demonstrated the weights, materials and share of packaging in the system.

The difference is significant:

Concept

What does it mean in practice?

Packaging certification

may concern material properties, e.g. recycling or technical compliance

VerpackG audit

verifies the compliance of data and obligations under the VerpackG

Declaration of Completeness

formal confirmation of packaging volumes for the previous year

Expert examination

independent verification of data by an authorised person

Dual system

financing the management of packaging subject to mandatory

It is useful to use the phrase „packaging certification” in an SEO article, but it needs to be clarified in the content so as not to wrongly imply that the Completeness Declaration is a material certification.

How to prepare a company for an expert examination?

Preparing for the survey should be a process, not a one-off action in May. The largest companies should have an internal packaging data procedure.

1. Determine the process owner

Who is responsible for VerpackG: the compliance department, logistics, e-commerce, accounting, the marketplace manager or the environmental person? Lack of process owner usually leads to inconsistent data.

2. Build a packaging matrix

Each product should be assigned unit, bulk and shipping packaging, along with material and weight.

3. Separate the sales channels

Own sales, marketplace, fulfilment and B2B can generate different data. They should not be mixed in one aggregate file without an audit trail.

4. verify the dual system operator

The data at the operator must match the data reported in LUCID. Discrepancies are one of the simplest signals of risk.

5. Prepare source documents

The auditor should have access to packaging specifications, sales reports, logistics data, dual system confirmations and LUCID submissions.

6. Carry out a trial audit

A trial audit before the deadline allows data errors to be detected before they become a formal problem.

At this point, it is naturally worth adding a link to VerpackG - step-by-step registration and to LUCID Audit, because the user may need both a review of responsibilities and support in the process.

Frequently asked questions

Does every company with a LUCID number have to submit a Declaration of Completeness?

No. The Completeness Declaration is submitted by companies that have reached or exceeded certain packaging thresholds in the previous year: 80,000 kg of glass, 50,000 kg of paper, cardboard and cardboard or 30,000 kg of light packaging. However, the ZSVR or the competent authorities may also request declarations below these thresholds.

By when is the Declaration of Completeness submitted to LUCID?

The Declaration of Completeness is submitted by 15 May for the previous calendar year. If the deadline falls on a weekend or holiday, it is postponed to the next working day, but it cannot be extended.

Who can carry out the Completeness Declaration survey?

The audit may be performed by an authorised auditor, expert, tax advisor or sworn accountant registered with the LUCID Packaging Register. Such a person must apply the ZSVR audit guidelines.

Can an auditor from Poland certify the Declaration of Completeness?

Not everyone. The key is whether the individual is qualified and registered on the relevant LUCID/ZSVR register. A professional qualification alone without the correct status on the ZSVR system may not be enough.

What is the penalty for not having LUCID in Germany?

There is a fine of up to €100,000 for breaching the registration obligation, up to €200,000 for breaching the obligation to participate in the dual system and up to €10,000 for data reporting errors. Violations can also lead to a ban on the distribution of packaged goods.

Is a VerpackG audit needed before crossing thresholds?

Yes, if the company is growing rapidly, has large e-commerce volumes, sells through a marketplace or is unsure whether the data in LUCID and the dual system are consistent. A pre-threshold audit allows you to prepare the process before the Completeness Declaration becomes mandatory.

Do you need a VerpackG audit or preparation for a Declaration of Completeness?

If your company sells large volumes of products to Germany, is approaching the Declaration of Completeness thresholds or wants to check the correctness of LUCID data and the dual system, contact EKOPRO Group.
