BDO vs LUCID - what are the obligations for Polish e-commerce selling in Poland and to Germany?<\/strong><\/h2>\n\n\n\n

If Polish e-commerce sells goods in Poland, the starting point is to assess the obligations in the BDO<\/strong>. In practice, BDO most often concerns shops which place packaged products on the national territory<\/strong>, as well as producers, importers and intra-Community purchasers of packaging. The official BDO registration rules indicate that the obligation to register applies to the entities listed in the Waste Act and, for activities requiring registration, the entrepreneur himself submits the application electronically. For an online shop, this usually means analysing whether it sells goods under its own brand, packages a product for marketing or imports packaging or packaged products for business purposes.<\/p>\n\n\n\n

When does Polish e-commerce need BDO and when does LUCID come into play?<\/strong><\/h2>\n\n\n\n

The most important difference is simple: BDO concerns obligations in Poland<\/strong>, a LUCID applies to packaging marketed in Germany<\/strong>. If the shop only sells in Poland, it primarily assesses BDO. If it also sells to Germany and introduces packaged goods there, it should additionally check the obligations in the LUCID Packaging Register<\/strong>. The German ZSVR indicates explicitly that if a company distributes packaged goods in Germany, it must be registered with LUCID, regardless of where it is based. This means that a Polish online shop can simultaneously be subject to the BDO in Poland<\/strong> i LUCID in Germany<\/strong> - These are two separate systems and one does not replace the other.<\/p>\n\n\n\n

What fees and reports appear in BDO and LUCID<\/strong><\/h2>\n\n\n\n

In BDO, only selected groups of entrepreneurs are subject to the registration and annual fee, including the following manufacturer, importer and intra-Community buyer of packaging<\/strong> and introducing on the national territory packaged products<\/strong>. The current rate is PLN 200 for a micro-entrepreneur and PLN 800 for other entrepreneurs<\/strong>, and an annual fee shall be paid until the end of February<\/strong>. This is supplemented by an annual report on products, packaging and the management of waste arising from them, submitted to the by 15 March for the previous calendar year<\/strong>. At LUCID, registration itself is free<\/strong>, but for packaging covered by the mandatory participation system, one must additionally conclude a contract with the operator of the dual system and report packaging data. This means that BDO and LUCID differ not only in their territorial scope, but also in their cost structure: in Poland there is a statutory registration fee and an annual fee, while in Germany the registration itself is free of charge, but the costs of the dual system are added.<\/p>\n\n\n\n

The most common mistake is to assume that since the shop already has a BDO number, it does not need to deal with LUCID when selling to Germany. This is not true. The second typical mistake is the opposite thinking: registration with LUCID does not take care of environmental obligations in Poland. For Polish e-commerce, the correct logic should look like this: firstly, assessing whether a company in Poland is those introducing packaging<\/strong> or those introducing packaged products<\/strong>, followed by a separate assessment of whether sales to Germany mean that the company's markets packaged goods in Germany<\/strong>. Only after this separation can it be correctly determined whether a company has only BDO, only LUCID or both obligations at the same time. It is this practical separation that best answers the real questions of online shop owners selling domestically and cross-border.<\/p>\n\n\n\n
