If you run a construction company and are wondering whether BDO applies to you, the most important answer is: not every construction company automatically has to have an entry, but in practice very many such companies are subject to registration<\/strong>. The key issue is who, in the eyes of the law, is the waste producer<\/strong>. As a general rule, the entity that provides the service, i.e. most often the contractor, is responsible for waste arising from construction, demolition, renovation, cleaning, maintenance and repair work. Such an entity, as the generator of waste, is obliged to register with the BDO Register and keep records, unless the contract for the provision of the service expressly allocates responsibility for the waste generated differently.<\/p>\n\n\n\n

When a construction company must register with BDO<\/strong><\/h2>\n\n\n\n

Registration with BDO is required when a construction company, as a contractor of works, generates waste covered by the obligation to keep records and does not benefit from the exemptions provided by the legislation. In practice, this means that the obligation is not determined by the industry name itself, but by the actual operating model, the type of waste and whether the company remains a generator of waste. It is also important to note that from 1 January 2025, records must be kept for all hazardous waste regardless of quantity<\/strong>, which, for some construction companies, means that they have to reassess their obligations. If the activity requires registration on application, the entrepreneur should submit an application prior to the commencement of operations<\/strong> subject to registration.<\/p>\n\n\n\n

For the construction company, the BDO entry itself is only the beginning. Entrepreneurs with waste keep records electronically in the BDO system, and when handing over waste, the generator issues a Waste Transfer Note (KPO)<\/strong>, indicating, inter alia, the code, type and weight of the waste. The transferee then confirms the takeover and the transporter confirms the completion of the transport. In addition, the annual report on waste generated is submitted electronically via an account in the BDO system to 15 March<\/strong> for the previous year. From the perspective of the construction industry, it is also important that the system allows records to be kept from the company's registered office, so there is no need to create a separate place of business for each construction site, but the entry should be correctly updated for service activities carried out across the country.<\/p>\n\n\n\n

When a construction company may not be subject to BDO registration<\/strong><\/h2>\n\n\n\n

There are situations in which a construction company does not have to register with BDO as a waste generator. The most important exception is where the service contract transfers responsibility for the waste to another entity, such as the builder. The second important area is the exemptions from record-keeping: if a contractor only generates such types of waste and in such quantities that fall within the limits set out in the regulation of 5 November 2024, it does not keep waste records and is therefore not subject to registration in BDO as a waste generator. This, however, requires a very careful analysis of the contract and the actual waste stream, as a misjudgement can be costly: for operating without the required registration, an administrative fine of PLN 1 000 to PLN 1 000 000<\/strong>, and for transporting waste without an entry from PLN 2 000 to PLN 10 000<\/strong>.<\/p>\n\n\n\n
